General Booking Terms and Conditions

These terms and conditions govern bookings made for accommodation managed by Jaén Rural, whether through its website or through other sales channels or direct communication methods.

By making a booking, the lead guest confirms that they have read, understood and accepted these terms and conditions, together with the specific conditions displayed during the booking process.

1. Lead guest

The person making the booking must be at least 18 years old and must provide accurate and up-to-date information.

The lead guest will be responsible for payment of the booking, the conduct of all guests and compliance with these terms and conditions.

Bookings are personal and may not be transferred to another person without prior authorisation from Jaén Rural.

2. Booking confirmation

All booking requests are subject to availability and acceptance by Jaén Rural.

A booking will be considered confirmed when:

  • The booking process has been completed correctly.

  • The required amount has been paid.

  • The guest has received confirmation by email or another written means.

The accommodation will not be definitively reserved until the required payment has been received and the booking confirmation has been issued.

Jaén Rural may reject a booking request before confirmation. In this case, any amount already charged will be refunded.

3. Price and payment

The total price will be the amount displayed during the booking process and will include the taxes and services expressly indicated.

As a general rule, payment will be made as follows:

  • An initial payment of 30% of the total amount to confirm the booking.

  • The remaining amount must be paid before arrival or at the time specified in the booking confirmation.

The specific conditions of a rate, promotion or accommodation may establish a different payment schedule. In this case, the conditions displayed and accepted during the booking process will prevail.

Failure to make payment within the established deadlines may result in cancellation of the booking.

4. Security deposit

Certain properties may require a security deposit to cover possible damage, losses, extraordinary consumption or breaches of the accommodation rules.

The amount and payment method will be communicated before the booking is confirmed or stated in its specific conditions.

The security deposit may not be used as payment for the accommodation. It will be returned after the condition of the property has been checked, less any applicable charges relating to:

  • Damage or breakages.

  • Lost keys or access devices.

  • Extraordinary cleaning.

  • Consumption or services not included in the booking.

  • Breaches attributable to the guests.

If any amount is withheld, the lead guest may request information or supporting documentation concerning the costs incurred.

5. Duration of the stay

The stay will last for the period specified in the booking confirmation.

Departure after the agreed date or any extension of the stay will require prior express authorisation from Jaén Rural, will be subject to availability and may incur additional charges.

The accommodation is intended exclusively for tourist or temporary use and will not constitute the guest’s permanent residence.

6. Check-in and check-out times

As a general rule:

  • Check-in will take place between 3:00 p.m. and 10:00 p.m.

  • Check-out must be completed before 11:00 a.m.

Any arrival outside the established times must be communicated in advance and will be subject to confirmation. Certain properties may apply specific conditions or additional charges for late arrivals.

On the day of departure, the accommodation must be vacated by all guests and their belongings within the established time and left in a reasonable state of cleanliness and order.

7. Guest identification and registration

Before check-in, all guests must complete the legally required guest registration process and provide the necessary identification documents.

Only the people identified and included in the booking may access and stay overnight at the accommodation.

Refusal to provide the legally required information or the submission of false information may result in access to the accommodation being denied without entitlement to a refund.

8. Maximum occupancy

The maximum authorised occupancy of the accommodation may not be exceeded. This includes children and babies unless expressly stated otherwise.

The presence of unregistered visitors must be authorised in advance by Jaén Rural.

If the contracted occupancy is exceeded, Jaén Rural may:

  • Require unauthorised persons to leave the property.

  • Apply the corresponding additional charge.

  • Terminate the stay in the event of a serious or repeated breach.

9. Rules of use and conduct

Guests must use the accommodation, its facilities, furniture and equipment responsibly.

During their stay, guests must:

  • Respect the neighbours’ right to rest.

  • Comply with the rules of the building, community and accommodation.

  • Avoid excessive noise, parties or disruptive activities.

  • Refrain from carrying out illegal, dangerous, unhealthy or commercial activities.

  • Refrain from bringing flammable or explosive materials or prohibited substances into the property.

  • Refrain from smoking inside the accommodation unless expressly permitted.

  • Keep the facilities in an appropriate state of repair and cleanliness.

Parties, celebrations and events are not permitted without prior authorisation.

Justified complaints from neighbours, intervention by the authorities or a serious breach of these rules may result in the early termination of the stay, without prejudice to any costs or damages that may be claimed.

10. Care of the property, damage and incidents

Guests must return the accommodation in a condition similar to that in which it was received, except for normal wear and tear.

Any damage, fault or incident must be reported to Jaén Rural as soon as possible. Any issues identified upon arrival should preferably be reported within the first 24 hours.

The lead guest will be responsible for damage caused by them or by any accompanying guest.

Jaén Rural may access the accommodation, with prior notice whenever possible, to carry out urgent repairs, inspect an incident or prevent further damage.

No item, furniture, equipment or inventory element may be removed from the accommodation.

11. Keys and access systems

Keys, remote controls and access codes are personal and may only be used during the stay.

Guests may not make copies or provide access details or devices to unregistered persons.

Loss, damage or failure to return keys or access devices may result in a charge corresponding to the cost of replacement, travel, call-out services, door opening or lock replacement.

If guests leave the keys inside the accommodation or in the inside lock, they will be responsible for the costs of opening the door when the incident is attributable to their actions.

12. Pets

The admission of pets will depend on the specific conditions of each accommodation.

Where pets are permitted, they must be declared during the booking process and may be subject to prior authorisation, additional charges or specific rules.

Bringing an animal into accommodation where pets are not permitted may result in additional charges or termination of the stay.

This restriction will not apply to legally recognised assistance dogs.

13. Utilities

Normal consumption of water, electricity and other utilities will be included unless otherwise indicated.

For stays of more than 14 days, a combined limit of €60 may be established for included utility consumption. If this limit is exceeded due to extraordinary consumption, Jaén Rural may charge the difference and provide the corresponding information.

Guests must use utilities responsibly and switch off lights, air-conditioning, heating and electrical appliances when they are not required.

14. Internet and Wi-Fi

In properties with Internet access, Jaén Rural will provide the information required to connect to the service.

The availability, speed and quality of the connection may depend on third-party providers, local coverage or technical circumstances beyond the control of Jaén Rural. A temporary interruption will not automatically entitle the guest to compensation, although reasonable steps will be taken to resolve the issue.

Guests are responsible for their use of the connection and agree not to use it for illegal activities or activities that infringe the rights of third parties.

15. Personal belongings

Jaén Rural will not be responsible for the loss, theft or damage of money, documents or personal belongings left in the accommodation unless liability can legally be attributed to the company.

Items left behind will be kept for a reasonable period. They may be sent to the guest upon request, with shipping costs payable by the guest.

16. Cancellations and amendments

The cancellation conditions applicable to the booking will be those displayed and accepted during the booking process.

Unless the booked rate establishes different conditions:

  • If the booking is cancelled or amended at least 10 days before arrival, 30% of the total amount may be retained or charged.

  • If the booking is cancelled or amended less than 10 days before arrival, the full amount of the stay may be charged.

  • In the event of a no-show, early departure or reduction of the stay after check-in, no refund will be given for unused nights.

All amendment requests will be subject to availability. Changes to dates, accommodation, occupancy or duration may result in a price adjustment.

Non-refundable rates will be governed by their specific conditions.

17. Cancellation or amendment by Jaén Rural

If, for a justified reason, force majeure or circumstances beyond the control of Jaén Rural, it is not possible to provide the booked accommodation, Jaén Rural will attempt to offer an alternative of similar or higher characteristics.

If the guest does not accept the alternative or no suitable alternative is available, any amounts paid for services not provided will be refunded.

Jaén Rural may terminate the stay early in the event of a serious breach of these conditions, particularly in cases involving:

  • Exceeding the maximum occupancy.

  • Parties or serious disturbance.

  • Deliberate damage or dangerous conduct.

  • Illegal activities.

  • Repeated failure to follow safety instructions.

Termination for reasons attributable to the guest will not prevent Jaén Rural from claiming compensation for any damage or expenses incurred.

18. Liability

Jaén Rural will not be responsible for damage arising from:

  • Improper use of the facilities.

  • Negligent actions by the guest.

  • Interruptions to utilities or services attributable to third parties.

  • Circumstances of force majeure.

  • Accidents occurring outside the accommodation or during activities not organised by Jaén Rural.

Nothing in these terms and conditions will limit the rights granted to consumers and users under applicable legislation.

19. Assistance during the stay

Guests may contact Jaén Rural during the customer service hours stated in the booking confirmation.

Outside these hours, the emergency telephone number must only be used for urgent situations involving safety, access to the accommodation or a serious incident at the property.

Costs arising from unnecessary call-outs or incidents caused by the guest may be charged to the guest, subject to justification.

20. Data protection

The personal data provided will be processed by Jaén Rural S.L., with Tax Identification Number B22787071 and registered address at  Calle Jódar, 60, 23400, Úbeda, Jaén, for the following purposes:

The legal basis for processing will be the performance of the contractual relationship, compliance with legal obligations and, where applicable, the consent of the data subject.

22. Applicable law and jurisdiction

These terms and conditions will be governed by Spanish law.

The parties will attempt to resolve amicably any dispute relating to the booking.

If an agreement cannot be reached, the courts and tribunals determined by the applicable legislation will have jurisdiction. Where the guest is acting as a consumer, this clause will not restrict their right to bring proceedings before the courts with jurisdiction according to their place of residence.

23. Acceptance of the terms and conditions

Confirmation of the booking implies acceptance of these general terms and conditions, as well as the specific conditions of the selected accommodation and rate.

In the event of a discrepancy, the specific conditions displayed during the booking process will prevail, provided that they have been expressly accepted by the guest.
